Auction Terms

Items are located at 3164 Freeway Lane, Saginaw Mi 48601. For questions regarding listings; please contact Don or the sales department at (989) 776-1770. Sale items can be viewed and inspected on Monday and Tuesday from 8:00 am to 5:00 pm. All items purchased on-line are to paid for and picked up within 3 days from the auction end date. We are open for pick up and payment Monday – Friday 8:00 am – 4:30 pm. When a bid is accepted by the credit union, bank, court, trustee or lien holder, it is considered a legal binding contract, and all sales are final. After 3 days since notification of acceptance, the item may be re-listed or sold to the next bidder.

All items are sold “as is where is”, with NO guarantee, warranty, or possible refund written, expressed, or implied with the exception of our Certified Green Light items (Green Light means our mechanic has looked over the unit and completed repairs for a 5 day or 250-mile warranty, whichever comes first). We list the condition of the items as we know them, conditions are listed for convenience only, some conditions are unknown. Please note that all sales are final regardless of the condition. It is the buyer’s sole responsibility to inspect, confirm, and investigate items before bidding. Buyrepos.net disclaims the accuracy of item information shown on the web site. Please note that if an item is not paid for and picked up within 3 days from the date of the auction, unless specified otherwise in writing from the auctioneer, the bidder will be in default and the item may be resold. The defaulting bidder will be banned from future auctions and will be required to pay a restocking fee of %5 (minimum of $50 and maximum of $1500).

A “soft close” bid will activate if there is an active bid placed on an item at 7:59:00 pm to 7:59:59 pm. If at 8:00 pm there are no bids placed in the last minute, the auction will be closed. If a bid is placed during the last minute, the auction for that item will extend 10 minutes. Bidding during the first 9 minutes of the extended time does not extend the time another 10 minutes unless a bid is placed in the last minute of the extension.

Examples:

• Original bid = 7:52 pm. No other bids = item will close at 8:00 pm.
• Original bid = 7:52 pm, another bid at 7:59:02 pm, bidding will be extended and closed at 8:09:02 if no other bids are made.
• Original bid = 7:52 pm, another bid at 7:59:02 pm, bidding will be extended until 8:59:02 pm. Original bidder places another bid at 8:05:10 pm = bidding will close at 8:09:02 pm.
• Original bid = 7:52 pm. Another bid at 7:59:02 pm, bidding will be extended until 8:59:02 pm, original bidder places another bid at 8:08:25 = bidding will be extended until 8:18:25 pm.

All sales are contingent upon approval from the credit union, bank, court, trustee, or lien holder affiliated with the item. Winning bidders will be notified when the bid is accepted, or offered a counter bid by the seller.

Note to buyers of titled items: Michigan Recovery Services Inc. is required by the State of Michigan to broker all vehicles. All appropriate paperwork required by the state must be signed for title transfers. We can apply for plates and registration through the Secretary of State for you (proof of insurance is required). Vehicles without registration, plates, and insurance must be towed or trailered. There is a $275 buyers fee, a document fee required by the state of %5 (maximum $260) and Michigan sales tax due at time of purchase. Title and registration fees, if chosen, are due at the time of purchase. Please note: title processing may take up to 15 days.

For out of country buyers: the State of Michigan requires we collect %6 sales tax and transfer the title as an “In Transit” through the Secretary of State before a title can be issued. All out of country buyers need to contact our sales department at (989) 776-1770 ext.3 to start the paperwork before the item can be taken across the border. Out of country titles may take 3-5 weeks

Rights to Suspend or Terminate

You agree that this web site, in its own discretion, may terminate any auction item or use of the service immediately and without notice if:

• We believe that you are not abiding by the general rules
• You have repeatedly broken any term
• You have listed a suspicious item
• We believe you are a non-paying bidder

In most cases when we suspect foul play, we will suspend your account/listing during investigation. If we conclude you have broken the terms your account will be terminated.

Conduct

You are solely responsible for your actions through this web site. You must ensure that your participation in the buying or selling of items does not violate any applicable laws or regulations. You must verify that you are entitled to buy or sell relevant items and that you are not prohibited from doing so by any law or regulation.

You must not transmit, through the service, any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material. You must not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable law or regulation.

Membership

Membership to this web site is only available to those who can form a legally binding contract. This site does not permit minors (under 18) to register. If any member fails to disclose their correct age, the account will be terminated immediately.

This site acts as the window for sellers to conduct auctions, and for bidders to bid on sellers’ auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety, or legality of the items listed, the truth or accuracy of the listings, the ability of the sellers to sell items, or the ability of the buyers to buy items. We cannot control whether the sellers will complete the sale of items they offer, or whether the buyers will complete the purchase of items they bid on.

Note that there is a risk of dealing with foreign nationals, underage persons, or people acting under false pretenses. This web site shall not be responsible for any items sold by auction, for any damage to items during transit, or during the inspection period, nor for misrepresentations and/or breaches of contract by either the buyer or seller. This web site shall not be responsible for the cost of procurement of substitute goods or any losses resulting from any goods purchased or obtained.

This web site assumes no liability for the content of the listings. However, if you fall victim to a fraudulent transaction, we will assist you as much as we can.
